Methods of Payment

We accept the following credit cards: Visa, MasterCard, Discover, and American Express. Checks are also accepted, however checks will be held for approximately 10 days or until the check clears. In the event your check is dishonored or returned for any reason, you authorize us to electronically (or by paper draft) re-present the check to your bank account for collection of the amount of the check, plus a $25.00 fee as permitted by state law. Money orders in US funds are also accepted. We do not ship via COD (cash on delivery).

Credit Card Authorizations

Online orders are subject to credit card authorization and verification. To avoid delays with your order, please be certain all billing information entered exactly matches your credit card issuing bank records. HappyIsHome.com submits a credit card authorization that your bank uses to reserve the funds for your order once you have placed your order online. This may show on your credit card statement as a pending charge. HappyIsHome.com will not actually charge your credit card until your order has been shipped. If your order is cancelled, your pending charges will be released within 3–7 days per your issuing credit card bank policies. Bank policies' regarding authorization holds can vary so please contact your credit card issuing bank to review their policy.

Sales Tax Policy

HappyIsHome.com is required by law to charge sales tax in any state we have nexus. We are physically located in California with distribution centers in Florida, North Carolina and Texas. Companies are required by the state and local tax authorities to pay sales tax on all items that are sold in or shipped to a location within a state where we have nexus.Therefore, sales tax is collected in those states.

Email Confirmations

An email confirmation will be sent to you as soon as we receive your order. Another email will be sent notifying you when your order has been shipped (including a tracking number when available). Registering a New Account with HappyIsHome.com You do not need to be a registered HappyIsHome customer to place an order. However registering an account allows us, if you wish, to save your address and credit card details for future orders, and track the status of your orders. You may register while placing an order or *click on the login tab *at the top of the page. Click on “New Customer” and fill in all required fields.

Managing Your Account

By logging in you may change your e-mail address, change your password, change your billing address, change and add multiple shipping addresses, update credit card information and view orders. Only one billing address is permitted, but multiple shipping addresses can be stored. Orders are automatically shipped to the default shipping address unless another address is selected or entered in the shipping field. Did you forget your password? No problem. Simply login with your e-mail address and select “Click here if you’ve forgotten your password.” HappyIsHome email password instructions to the email address associated with your account. If by chance your account does not have a valid email address associated than please call us at (866)516-5535.

Back Order Policy

If an item is backordered for less than 5 days we will hold the entire order to ship it complete. If the backorder is expected to take longer we will ship what items are in stock and the backorder(s) when it arrives (you will not be charged any additional delivery if a backorder must be sent separately). If you have not received an email from HappyIsHome please check your spam folder. You will need to manually add contact@happyishome.com to your approved domain list in order to receive future e-mails from us.

Cancellation or Modification

Changes can only be made over the phone. You may call us to make changes to your order only if your order has not yet been sent to the warehouse to be cut and packed for shipping. An order cannot be modified or cancelled after the fabric has been cut. Adding additional items that will increase the original total amount will require a new credit card authorization. The original authorization will automatically expire in 2 to 10 business days depending on your financial institution, but until that time will reserve a portion of your total credit. You will receive a new order confirmation reflecting the change(s) via email and a ship confirmation when the order ships. Your credit card will not be charged until the order actually ships.

Fabric Disclaimer

HappyIsHome.com is engaged in the business of only selling first quality fabrics. In the fabric industry first quality fabrics will still have a few flaws. Glen Raven, Inc. who is the manufacturer of Sunbrella fabric permits up to 6 flaws per 60-yard roll to still be classified as first quality fabric. This averages out to 1 flaw per every 10 yards. HappyIsHome.com will make every effort to avoid sending a flaw with fabric orders less than 5 yards. If longer cuts are required, HappyIsHome.com recommends ordering additional fabric to compensate for the occasional flaw. Manufacturer flaw tags can be found on the edge of the fabric so the flaws can be avoided or inconspicuously placed when patterning your projects.

Due to the limitations of desktop scanners, digital cameras, and the relative inconsistencies of various display monitors, the colors and other characteristics you see on your screen may not be a totally accurate reproduction of the actual product. We strive to make our colors and other characteristics as accurate as possible, but screen images are intended as a guide only and should not be regarded as absolute replication of the product color and other characteristics. We recommend ordering fabric color samples before final purchase.

Suggested fabric coordinates are simply suggestions.

Limitation of Liability

Buyer acknowledges and agrees that seller’s liability for any claims with respect to the products shall not exceed the amount paid by buyer for the products under the invoice. Such limitations on seller’s liability hereunder shall apply even if seller’s liability is due in whole or in part to its own negligence. Any action by or on behalf of Buyer or its successors or assigns for breach of this document must be commenced within one (1) year after the cause of action as accrued.

Indemnity

Buyer shall defend, indemnify and hold harmless Happy Is Home and its affiliated or related companies from and against any and all claims, losses, liability, damages and expenses including, but not limited to, attorneys’ fees and cost of defense arising from, related to or in any way connected with or alleged to arise from or out of any asserted deficiencies or defects in Product caused by any alteration or modification thereof by Buyer with or without Seller’s consent, or improper handling or storage by Buyer, the breach of any term or condition stated herein, Buyer’s failure to label Product or Buyer’s improper labeling of Product regardless of whether the labeling was done with or without the advice of Seller.
